Disciplinary Committee Draft Minutes of Meeting - 9/10/11 The Disciplinary Committee met on September 10, 2011 to address the following agenda of cases. Members present were Pam Kahn, Tom Kane, Robert Noye, Tony Sabia and Dick Covey. Excused members were Chairman Jim Locantro, Michael Krakow, Arnie Milidantri and Mike Messina. Community Manager Ralph Graf was also present. CITATION DISPUTE AGENDA CASE 1: XXXXXX, Owner Lot XXXX The committee heard the case of a disputed Speeding citation by the defendant. The citation and the fine of $50.00 were upheld by the committee. CASE 2: XXXXXX, Owner Lot XXXX The committee heard the case of a disputed Failure to Comply citation (Parking on Emergency Access Road) by the defendant. The citation was upheld but the fine of $125.00 was reduced to $25.00 by the committee due to confusion with signage. RULES VIOLATION AGENDA CASE 1: XXXXXX, Owner Lot XXXX The Committee heard the case of violations resulting from actions by a daughter of a member and guests involving an underage drinking party at Lot XXXX. Said actions involved violating Article IV, Section 10c, subsection ii of The Hideout POA Bylaws and Section 2, Item J. of the Declaration of Protective Covenants. The defendant was found guilty of all charges and a fine of $250.00 for the underage party was levied by the committee. Respectfully submitted, Joseph E. Members present were Chairman Jim Locantro, Pam Kahn, Tom Kane, Robert Noye, Tony Sabia, Michael Krakow and Arnie Milidantri. Excused members were Mike Messina and Dick Covey. Security Director Joseph Kozuch was also present. CITATION DISPUTE AGENDA CASE 1: XXX, Owner Lot XXX The committee heard the case of a disputed Stop Sign & Yield Sign and Failure to Comply citations by the defendant. The Stop Sign & Yield Signs citation and the fine of $25.00 were upheld by the committee. The Failure to Comply citation was withdrawn and the fine of $125.00 was refunded by the Committee. CASE 1: XXX, Perm. Guest Lot XXX The committee heard the case of a disputed Stop Sign & Yield Sign and Failure to Comply citations by the defendant. Both citations and the fines of $25.00 and $125.00 respectfully were upheld by the committee. RULES VIOLATION AGENDA CASE 1: XXX, Owner Lot XXX The Committee heard the case of violations resulting from actions by renters and guests involving an underage drinking party at Lot XXX. Said actions involved violating Article IV, Section 10c, subsection ii of The Hideout POA Bylaws and Section 2, Item J. of the Declaration of Protective Covenants. The defendant was found guilty of all charges and a fine of $1,100.00 was levied for the underage party, $200.00 for the presence of a controlled substance on the premises and $200.00 for the need for emergency medical services for a total fine of $1500.00 being levied by the committee. CASE 2: XXX, Owner Lot XXX The Committee heard the case of violations resulting from actions by a son of a member and guests involving an underage drinking party at Lot XXX. Said actions involved violating Article IV, Section 10c, subsection ii of The Hideout POA Bylaws and Section 2, Item J. of the Declaration of Protective Covenants. The defendant was found guilty of all charges and a fine of $250.00 for the underage party was levied by the committee. Respectfully submitted, Joseph E. Kozuch, Security Director Disciplinary Committee Draft Minutes of Meeting - 5/7/11 The Disciplinary Committee met on May 7, 2011 to address the following agenda of cases. Members present were Chairman Jim Locantro, Dick Covey, Pam Kahn, Mike Messina, Robert Noye, Tony Sabia, Michael Krakow and Arnie Milidantri. Excused member was Tom Kane. Security Director Joseph Kozuch was also present. RULES VIOLATION AGENDA CASE 1: XXX, Owner Lot XXX The committee heard the case of violations resulting from the actions of authorized guests of XXX, owner of lot XXX. Said actions involved violating Article IV, Section 7a&b, of The Hideout POA Bylaws, Article IV, Section 10c, subsection ii of The Hideout POA Bylaws and Section 2, Item J. of the Declaration of Protective Covenants. That is the judgment of the Disciplinary Committee that the defendant be found guilty of all charges and a fine of $100.00 per violation, totaling $300.00, was levied by the Committee. The Committee suspended the fine until January 1, 2012. If, by January 1, 2012, the defendant is not cited for violations of our governing documents as a result of the actions of his guests or renters, the fine will be rescinded. CASE 2: XXX vs. XXX & XXX The committee heard the case involving filed Suggestion / Complaint Record #’s 0392, 0391 and 0390 submitted by the above parties.
