DISCIPLINARY COMMITTEE HEARING MINUTES - March 3, 2007 The Disciplinary Committee met on March 3, 2007 to address the following agenda of cases.
CITATION DISPUTE AGENDA CASE 1: The committee heard the case of a disputed Speeding citation in the absence of the defendant who did accept the certified mail delivery notification of the proceedings. The citation and the fine of $100.00 were upheld by the committee.
CASE 2: The committee requested a continuance due to the fact that only the member was present and not the defendant himself. The committee continued the case and will place it on the agenda for the next Disciplinary Committee hearing.
CASE 3: The committee heard the case of a disputed Speeding citation by the defendant. The citation was upheld but the fine of $150.00 was reduced to $100.00 by the committee.
CASE 4: The committee heard the case of a disputed Speeding citation in the absence of the defendant who did accept the certified mail delivery notification of the proceedings. The citation and the fine of $150.00 were upheld by the committee. CASE 5: The defendant requested a continuance due to his inability to be present this day. The committee complied with the request and the case will be placed on the agenda for the next Disciplinary Committee hearing.
RULES VIOLATION AGENDA CASE 1: The committee heard the case of a disputed Harassment of Staff citation by the defendant. The citation and the fine of $125.00 were withdrawn by the committee with the understanding that this would be considered a warning.
CASE 2: The committee heard the case of a disputed charge of damage done to the benches at Reflection Park by the defendant’s son. The charge was upheld with a $500.00 fine along with an additional $1250.00 restitution for the replacement of the benches was levied by the committee. --------------------------------------- DISCIPLINARY COMMITTEE HEARING MINUTES - May 5, 2007 The Disciplinary Committee met on May 5, 2007 to address the following agenda of cases
CITATION DISPUTE AGENDA CASE 1: The committee heard the case of a disputed Littering citation by the defendant. The citation was changed to a warning and the fine of $200.00 was refunded by the committee.
CASE 2: The committee heard the case of disputed Speeding & Harassment of Staff citations by the defendant. The Speeding citation and the fine of $75.00 were upheld by the committee. The Harassment of Staff citation and the fine of $125.00 were upheld and the committee levied an additional fine of $125.00.
CASE 3: The defendant requested a continuance due to the inability of his witnesses to be present this day. The committee complied with the request and the case will be placed on the agenda for the next Disciplinary Committee hearing. --------------------------------- DISCIPLINARY COMMITTEE HEARING MINUTES - July 21, 2007 The Disciplinary Committee met on July 21, 2007 to address the following agenda of cases.
CITATION DISPUTE AGENDA CASE 1: The committee heard the case of a disputed Parking on Any Street in Snow Emergency citation in the absence of the defendant who was notified via certified mail (never returned) and regular mail of the proceedings. The citation and the fine of $35.00 were upheld by the committee.
CASE 2: The defendant requested a continuance due to his inability to be present this day. The committee complied with the request and the case will be placed on the agenda for the next Disciplinary Committee hearing.
CASE 3: The Security Director requested a continuance due to the inability of a witness to be present this day. The committee complied with the request and the case will be placed on the agenda for the next Disciplinary Committee hearing.
CASE 4: The committee heard the case of a disputed Trespass, Contractor Working After 1700 Hours, Failure to Comply & Disorderly Conduct citations in the absence of the defendant who did accept the certified mail delivery notification of the proceedings. The citations and the fines of $125.00, $125.00, $125.00 & $125.00 for a total of $500.00 were upheld by the committee.

CASE 2: The committee heard the case of Violation of Side Yard Setback in the absence of the defendant who was notified via certified mail (failed to pick up) and regular mail (never returned) of the proceedings. The committee levied a fine of $2500.00 for the violation with the stipulation if the shed is moved within sixty days of notification of disposition; the fine will be reduced to $500.00
CASE 3: The committee heard the case brought by member [Redacted], complainant {added}, concerning an alleged violation of General Rule 12 of the Consolidated Rules and Regulations by member, [Redacted] respondent {added}. After a hearing by the committee [redacted] respondent {added} was found in violation of General Rule 12. He must submit a Disciplinary Committee approved letter of apology to [Redacted] complainant {added}, to be published in the September Hideabout Newspaper and posted on Channel 20. The written apology shall be presented to the Security Director no later than August 15, 2007. If the apology is not made or it is unsatisfactory, at the sole discretion of the Disciplinary Committee, a fine of $1000.00 shall be paid by [Redacted] respondent {added}, Notwithstanding the foregoing, if, after thirty (30) days from the receipt of this decision, Member [Redacted] respondent { added } neither writes the aforementioned apology nor tenders the Hideout the $1,000.00 fine, he will no longer be entitled to the privileges of membership. --------------------------------- DISCIPLINARY COMMITTEE HEARING MINUTES - September 8, 2007 The Disciplinary Committee met on September 8, 2007 to address the following agenda of cases. Members present were Chairman Jim Locantro, Dick Covey, Bill Carney, Pam Kahn, Joe Marold, Mike Messina, Tony Sabia, Tom Kane and Robert Noye. Security Director Joseph Kozuch was also present.
CITATION DISPUTE AGENDA CASE 1: ********, Guest Lot ***** The committee heard the case of a disputed Stop Signs & Yield Signs, Failure to Display Hideout Vehicle ID & Disorderly Conduct citations in the absence of the defendant who was notified via certified mail and regular mail of the proceedings. The citations and the fines totaling $175.00 were upheld by the committee.
CASE 2: ***********, Owner Lot ******* The committee heard the case of a disputed Harassment of Staff citation by the defendant. The citation was withdrawn and the fine of $125.00 was refunded by the committee.
CASE 3: ***********, Owner Lot ******* The committee heard the case of a disputed Failure to Comply citation by the defendant. The citation and the fine of $125.00 were upheld by the committee.
CASE 4: ***********, Owner Lot ******* The committee heard the case of a disputed Harassment of Staff citation by the defendant. The citation and the fine of $125.00 were upheld by the committee.
RULES VIOLATION AGENDA CASE 1: ***********, Owners Lot ****** The committee heard the case of Permit Status – Failure to Comply complaint against the defendant. The committee extended the compliance date until October 31, 2007. If non-compliant by due date a fine of $2500.00 shall be paid by the defendant.
CASE 2: Owner*******, Lot **** vs. , Owner Lot **** The committee heard the case brought by member ************** concerning her filed Suggestion / Complaint Record #0184 regarding ongoing harassment by her neighbor **********. The committee agreed that levying a fine would not serve any purpose in correcting the situation but only possibly making it worse. The committee decided that Committee Member Pam Kahn would attempt to intervene between the two in an attempt to reconcile the two parties.
CASE 3: **********Owner Lot **** vs. **************, Owner Lot **** The committee discussed Suggestion / Complaint Record # 0186 filed by **************, Owner Lot **** against **************, Owner Lot ****. The committee determined that no prima-facie case was established in the complaint and agreed that they would not hear the case. ------------------------------------------- The Disciplinary Committee meets on the first Saturday of every other month except for Holiday weekends. If the Saturday falls on a Holiday weekend then the meeting is usually scheduled for the following Saturday of that month. Disciplinary meetings are open to the membership. Members present were Chairman Jim Locantro, Dick Covey, Bill Carney, Pam Kahn, Mike Messina, Tony Sabia, Tom Kane and Robert Noye. Excused member was Joe Marold. Security Director Joseph Kozuch was also present.

CASE 2: XXXXXX, Guest Lot XXX The defendant failed to appear for the case of a disputed Expired Hideout vehicle ID citation. The defendant was notified of the proceedings by both certified and regular mail. The citation and the fine of $25.00 was upheld by the committee.
CASE 3: XXXXXX, Guest Lot XXX The defendant failed to appear for the case of two disputed Expired Hideout vehicle ID citations. The defendant was notified of the proceedings by both certified and regular mail. The citations and the fines of $25.00 per citation were upheld by the committee.

CASE 8: XXXX, Owner Lot XXX The committee heard the case of a disputed Speeding, Reckless Driving, Stop Signs & Yield Signs, Failure to Yield to Emergency Vehicle and Failure to Comply citations by the defendant. The citations were upheld and the fines were doubled for an additional fine levied by the Committee of $400.00 with the exception of Failure to Comply which was withdrawn.
CASE 9: XXXX, Owner Lot XXX The committee heard the case of a disputed Disorderly Conduct, Harassment and Damage to Gate citations by the defendant. The citations were upheld and the Disorderly Conduct & Damage to Gate fines were doubled for an additional fine levied by the Committee of $375.00.
CASE 10: XXXX, Owner Lot XXX The committee heard the case of a disputed Illegal Dumping citation by the defendant. The citation was upheld but the fine of $200.00 was refunded by the committee due to the lack of prior notification and signage at the time of the violation.

The committee determined that only the Security Department can file a complaint for speeding with the use of radar and agreed that they would not hear the case.
